Austin Nez Identified as Victim in Fatal Fargo Pedestrian Accident at Cass Clay Creamery

Fargo, North Dakota — Authorities have identified Austin Nez, a 31-year-old individual without a permanent residence, as the victim of a tragic pedestrian accident that occurred in Fargo on Thursday, August 15, 2024.

The incident took place early in the morning in the parking lot of Cass Clay Creamery, located at 200 20th St. N. Nez was struck and killed by a 2020 Capacity of Texas Inc. yard truck. The driver of the truck, 48-year-old Gregory Roller from Fargo, was unharmed in the accident and, according to the North Dakota Highway Patrol, will not face any criminal charges.

Officials noted that Austin Nez had no affiliation with the creamery. The accident has raised concerns about pedestrian safety in industrial areas, though the circumstances leading up to the incident remain under investigation.

The Fargo community is mourning the loss of Nez, who was described as a man without a permanent home, highlighting the often-overlooked vulnerabilities of homeless individuals in such tragic circumstances.
